As a long time follower of this saga and a former director of Save Picton Bay I wanted to reach out before you make any decision which will have long reaching implications for the health of Picton Bay and our community.
Firstly, you were correct in seeking a judgement from the Courts on the right of the County to enforce its Zoning and Land Use regulations. It is patently absurd for Picton Terminals to suggest that their federally regulated shipping operation somehow exempts them from municipal zoning by-laws. If this were the case, why did they apply to rezone the property in the first place?
Secondly, I would urge you to ‘follow the money’ and recognize that it is a very real possibility that Picton Terminals wants to transport garbage and other waste by containers to ports such as Oswego, N.Y. During the last settlement discussions with PT and the County and Save Picton Bay, we tried to get them to agree not to use the property for the import or export of a range of materials which, if dropped into the Bay, would pollute the water. It is interesting to note that the one change they ultimately stood fast on was the one related to Garbage/Municipal Waste. They only conceded they would not seek a change to the “current’ Zoning application. What does that tell you?
Lastly, I urge you to stay the course and follow through with the Court application and enforce County By-laws. If you don’t, this will set a terrible precedent and will throw into question the enforcement of Zoning By-laws elsewhere in the County.
