A continuance in the matter of the County of Prince Edward versus ABNA Investments (also known as Picton Terminals) was granted by Justice of the Peace David Auger in the Provincial Offences court on King St. Friday.
The port operation faces charges from the Municipality’s bylaw department for contravening permitted activities on the site. It continues to store large shipping containers on its property despite zoning that does not allow such use.
Standing before Justice Auger, prosecutor Kennedy Levesque explained disclosure was still to be gathered by the County and would be forwarded to the law offices of Cunningham Swan in the coming weeks. Patrick Barnes, of the Kingston law firm, agreed with Levesque that a 60-day continuance would allow enough time to receive and examine the disclosure before both the parties return to court Friday, Sept. 15 at 10am.
When questioned by Justice Auger whether the matter was headed to trial or resolution, lawyers for both parties stated it appears a joint submission to resolve the matter is in the offing.
